WAIVER AND RELEASE AGREEMENT

I, on behalf of myself, heirs, and/or assigns, assume all risk of accident, and agree that neither the St. Croix Yacht Club, Inc ("the Club"), nor any of its officers, directors, members, employees, agents, servants, or representatives, shall be liable, under any circumstances, nor bear any responsibility for any loss of life or injury to property or persons which may occur, however caused, before, during, or after the sailing instructional program session, regatta or other event. I, on behalf of myself, my family, my children, my wards, my heirs, and assigns, hereby voluntarily release, discharge, waive, and relinquish any and all claims actions and/or causes of action for personal injury, property damage or wrongful death against the Club occurring as a result of engaging in said activities, for whatever period said activities may continue, regardless of whether or not due in whole or any part to any act, omission, or negligence of the Club, Inc. and/or its officers, directors, members, employees, agents, servants,  or representatives, or by any other person, notwithstanding and regardless of the Virgin Islands Comparative Negligence Statute, Title 5, V.I.C. 81451.

I hereby agree to be responsible for and pay for any damage to property of the Club, beyond normal wear and tear, occurring while I, my family, my children and/or wards, are engaged in sailing instructional program sessions, regattas or other events.

I, acknowledge that I have read the foregoing paragraph, and have been fully and completely advised of the potential danger incidental to engaging in the activity and am fully aware of the legal consequences of this agreement.

Electronic Signature Agreement. By selecting the “I Accept” button, you are signing this Agreement electronically. You agree your electronic signature is the legal equivalent of your manual signature on this Agreement and consent to be legally bound by this Agreement’s terms and conditions.
